Anti-Spam Policy
Preliminary definitions
- “We,” “the company” or “FleetMailer” means the online email service provider.
- “Email” means electronic mail sent or used through the FleetMailer platform.
- “User” means the individual or legal entity that owns the service purchased from FleetMailer.
Definition of spam
Spam is any email not requested by its recipient, also known as UCE (unsolicited commercial email). There is no minimum sending volume for a message to be classified as spam.
FleetMailer policies
FleetMailer prohibits spam and unsolicited email. FleetMailer monitors each user’s activity and classifies a send as spam in the following cases:
- When a bulk send exceeds a 15% permanent-rejection rate.
- When one or more subscribers report the email as unsolicited.
- When a user attempts to upload a list of more than 5,000 subscribers without substantiating its origin.
- When the sender name or address is false.
- When the subject line is misleading or unrelated to the message content.
- When the email does not give the recipient a clear, visible and simple way to unsubscribe from the email list.
General rules for bulk email
Lists obtained from sources that are not the user’s own are prohibited, including purchased, borrowed or downloaded lists and any list of people who did not consent to subscribe.
The sender name must be the real name of the individual or legal entity responsible for the send. A trade name may be used for a business or company.
The sender-name field may not be used as an extension of the subject line or as any form of persuasion or incentive to make the recipient read the message.
The sender’s email address must be real and belong to that sender.
Scripts of any kind, including JavaScript, PHP or ASP, may not be inserted into the email body.
Obfuscated, encrypted or misleading links are prohibited in every part of the email.
Every email must provide real and legitimate sender or author information.
Messages may not be sent in another person’s name without that person’s express authorization.
Our system automatically monitors activity and may suspend or terminate the service early if it detects serious violations of our usage policies.
Penalties and violations
Any user who sends unsolicited email or spam will automatically be barred from continued use of the service without prior notice. The user will receive notice after interruption of the service with the relevant documentation. The user may request continuation and provide any explanation considered relevant, but the decision to continue the service remains solely with FleetMailer.
Damage to resources
Sending unsolicited email or spam may cause one or more anti-spam organizations to place the sending IP address on a blocklist.
Placement of an IP address on a blocklist may impair the service and cause email not to reach its destination or to be delivered to a spam folder.
If user negligence causes one or more IP addresses to be blocklisted, FleetMailer may take legal action against the user for the resulting damages.
