Privacy Policy

Spanish version controls. This English translation is provided for convenience. If it differs from the Spanish policy, the Spanish version prevails.

Preliminary definitions

  • “We,” “the company” or “FleetMailer” means the service provider.
  • “Email” means electronic mail sent or used through the FleetMailer platform.
  • “User” means the individual or legal entity that owns the service purchased from FleetMailer.

Types of information

Information provided by the user: all information supplied when requesting a service—including address, telephone number, email address, credit-card information, IP address or other personal information—is stored and used by FleetMailer solely for administrative purposes. These include notifications, due-date reminders, responses to questions and complaints, and other communications related to the service purchased by the client. FleetMailer does not publish, disclose or share information provided by the user.

List and campaign information: information entered by the user in FleetMailer, including email lists, HTML content and images, is for the user’s exclusive use. It is protected from external parties and will not be disclosed or shared with other users or parties outside FleetMailer. FleetMailer may, however, review information entered by the user when an investigation into its nature, legality or origin is required.

Contact lists

Your contact and subscriber lists are stored on secure servers provided by FleetMailer. FleetMailer will never use your lists, contact your subscribers, sell or publish your lists, offer services to contacts on your lists, or share them with third parties, except when required by law or in response to a complaint from an individual subscriber.

We will use or modify contact-list information only in the following cases:

  • To protect our rights and security or those of our employees, clients or others. We may review the information to verify compliance with our terms of use and national or international law.
  • In response to a legal or court request. We will provide user information to the competent authority only in response to a judicial request.
  • In the defense of legal proceedings. If we or a third party is harmed by misuse of the service, we may provide the user information necessary to defend those affected.

Information security

Sensitive data that could be used by a third party for commercial purposes—such as sending unsolicited emails to addresses or telephone numbers belonging to our users—is encrypted to maximize security and reduce the risk of theft in the event of an intrusion.

Limits on the use of information

No organization is entirely exempt from security breaches or forced intrusions. FleetMailer will notify you as soon as reasonably possible if it detects unauthorized access to our systems or platform.

Email content

Emails sent over the Internet travel through multiple servers from origin to destination. An administrator of any of those servers may be able to view the information in the email. Email was not designed to transmit confidential information. Do not use FleetMailer to send confidential information by email.

FleetMailer may review email content to verify compliance with our terms and conditions. We use automated mechanisms to detect content that may violate them.

Content is prohibited if it:

  • Violates national or international law.
  • Contains pornographic images or images exposing minors.
  • Contains links to fraudulent websites (phishing).
  • Contains links to third-party websites.
  • Promotes the sale of illegal substances or drugs.
  • Promotes the sale of medication related to sexuality.
  • Is offensive, degrading or humiliating.
  • Uses third-party trademarks without the trademark owner’s prior authorization.

Data retention

Personal information we store about a user will automatically cease to be used when the user requests cancellation of the service. We may nevertheless retain the information in case the user wishes to restore the service later.

The user has the full right to request deletion of personal data when cancelling the service. In that case, we will permanently delete the data at the time of cancellation.

The user may request cancellation at any time and under any circumstances. If services remain unpaid and the user requests cancellation and deletion of personal data, FleetMailer will observe the limits established by applicable law for deleting personal data stored electronically and may take the legal action necessary to collect unpaid amounts.
